Introduction to the Terms of Use Agreement

Our online store welcomes you, registered under number 1010530328. We inform you that below are the terms and conditions that govern your use of this store and all legal consequences arising from your use of the store's services through the World Wide Web via this electronic platform. By using Witforms, whether you are a consumer of the store’s service or product, or otherwise, this signifies your agreement and full acceptance of all the provisions of this agreement, and your commitment to comply with its regulations. This agreement applies to all types of dealings between the user and the store, excluding matters related to personal status or actions related to property deeds. This agreement becomes effective immediately once you agree to it and start registering with Witforms, according to Article 10 of the Saudi Electronic Transactions Law.

Article 1 - Introduction and Definitions:

The above preamble forms an integral part of this agreement. Below are the definitions of the main terms used in this agreement:

(The Store) refers to Witforms, including all forms of Witforms on the internet, whether as an app, website, or physical store.
(The User) refers to any consumer who purchases a product or service from the store through its electronic platform.
(The Agreement) refers to these terms and conditions, which govern and regulate the relationship between the parties of this agreement.

Article 2 - Legal Capacity of the User:

The user acknowledges that they are legally capable of dealing with the store and that they are at least eighteen (18) years old.
The user agrees that if they violate this article, they will bear the consequences of this violation before others.

Article 3 - Nature of Witforms' Commitment:

Witforms is committed to providing the service or product to consumers or users.
Witforms may provide other services, such as after-sales services, depending on the nature and type of the requested service or product.

Article 4 - Regulations for Using Witforms:

The user is committed to using the Witforms platform in accordance with public morals and the applicable laws in the Kingdom of Saudi Arabia.
The user commits, when purchasing a service or product from Witforms, to not use the service or product in a manner that violates public morals or the applicable laws in Saudi Arabia.

Article 5 - Accounts and Registration Obligations:

When applying for membership with Witforms, the user is obligated to provide certain information, select a username, and create a confidential password for use when accessing Witforms services. By doing so, the user agrees to:

Be responsible for maintaining the confidentiality of their account information and password, and agrees to immediately inform Witforms of any unauthorized use of their account or any breach of security.
Witforms is not responsible for any loss that may occur, directly or indirectly, whether financially or emotionally, due to the disclosure of the username or login details.
The user agrees to use their Witforms account personally and is fully responsible for it. If someone else uses it, it is considered as if the user has authorized them to use the store in their name and for their account.
The user agrees to use Witforms seriously and credibly.
The user agrees to provide truthful, accurate, updated, complete, and lawful information about themselves during registration and to update their information as necessary.
Witforms is committed to handling your personal information and contact details confidentially.
If it is found that the user has provided incorrect, outdated, incomplete, unlawful, or misleading information, Witforms has the right to suspend, freeze, or cancel the user's membership or account, without affecting Witforms' other rights or lawful means to recover its rights and protect other users.
In case of non-compliance with any of the above, Witforms has the right to suspend or cancel your store or membership or block your access to Witforms' services again.

Article 6 - Electronic Communications and Official Communication Channels:

The parties to this agreement agree that communication will be conducted via the registered email on the platform.
The user agrees that all agreements, announcements, statements, and other communications provided electronically will serve as valid written documents and will hold legal value in fulfilling legal and regulatory requirements.
The user agrees that Witforms may contact them with information about this agreement or any communication regarding dealings through broadcasting general messages to all users or specific users.

Article 7 - Amendments to the Terms of Use Agreement and Fees:

Witforms may notify the user of any amendments to this agreement through official communication channels. As a result, the user's obligations may increase or decrease depending on the modifications made.
If the user disagrees with any modification to the Terms of Use Agreement, Witforms asks that they stop using its services. Any continued access to the user's account or use of Witforms constitutes full acceptance of the modifications.
All fees are calculated in Saudi Riyals, and the user is responsible for paying all applicable fees on the platform, along with any additional charges imposed by Witforms, using the available payment methods provided by Witforms.
Witforms may impose fees on certain users depending on the offers, products, or services they request or any taxes or duties imposed by the government on the nature of the product or service.
Witforms reserves the right to add, increase, decrease, or discount any fees or expenses as per the terms of the Terms of Use Agreement, for any of its users, regardless of the reason for their registration.

Article 8 - Payment and Settlement Services for Stores on Witforms:

Witforms provides through its partners an online payment and settlement system, which may be fully processed online using the payment options available on Witforms or any other method provided by Witforms from time to time.
Witforms is obligated to determine the price of the service or product offered according to the market value.
Witforms is committed to providing invoices, receipts, and payment confirmations for all amounts and profits generated from the store and will provide the user with a purchase invoice for the service or product.
Witforms is committed to providing the standard accounting specifications in its online store to comply with the terms of this agreement, for legal, economic, commercial, and regulatory purposes.

Article 9 - Your Personal Information and Transaction Details:

The user grants Witforms an unlimited, worldwide, perpetual, irrevocable, royalty-free right to use any personal information or materials they have provided, whether through registration forms, emails, or any other communication channels available on the platform, for any of the purposes Witforms deems necessary.
The confidentiality of consumer information is governed by the "Privacy Policy and Confidentiality" of Witforms and the terms related to confidentiality in this agreement.

Article 10 - Intellectual Property:

The intellectual property rights of Witforms are fully owned by Witforms, whether before or after the establishment of this electronic platform.
The user or consumer agrees to respect Witforms' intellectual property rights, including Witforms itself, its name, logos, and other trademarks displayed on Witforms, as Witforms holds full intellectual property rights over all such matters.

Article 11 - Witforms' Liability:

Witforms is committed to conducting its business via this electronic platform in compliance with the laws and regulations of Saudi Arabia and the provisions of this agreement.
Witforms is not liable for any claims arising from errors or negligence, whether direct or indirect, incidental, or by the user or a third party, such as shipping companies.
Witforms and its affiliates are committed to ensuring that the product or service is sound, legal, and authorized in accordance with the laws and regulations of Saudi Arabia and is used for legitimate purposes.

Article 12 - Confidentiality of Information:

Witforms adopts physical, organizational, and technical measures to protect user information and prevent unauthorized access to personal user information.
The user acknowledges that the internet is not a completely secure medium, and confidentiality of personal information cannot be 100% guaranteed by Witforms.
Witforms has no control over the actions of third parties, such as external websites linked to the platform or third parties claiming to represent you or others.
The user agrees that Witforms may use the information provided for service delivery, marketing purposes, and privacy settings in accordance with the "Privacy Policy and Confidentiality" of Witforms.

Article 13 - Restriction of Access or Membership:

Witforms may suspend or cancel a user's membership or restrict their access to services at any time without prior notice and for any reason, without limitation.

Article 14 - Exchange Policy:

Without prejudice to the warranty provisions of this agreement, the consumer may exchange the product within seven days after receiving it. No exchange is allowed after this period.
To exchange the product, it must be in good condition, and the consumer should not have used or benefited from the product. Witforms reserves the right to inspect the product before exchanging it.

Article 15 - Return Policy:

Without prejudice to the warranty provisions of this agreement, the consumer may cancel the contract and return the product within seven days after receiving it.
To return the product, it must be in good condition, and the consumer should not have used or benefited from the product. Witforms reserves the right to inspect the product before accepting the return.
The consumer may not return the product under certain conditions as specified in the agreement.

Article 16 - Governing Law:

This Terms of Use Agreement is governed by and construed according to the laws and regulations in force in Saudi Arabia, and it is subject entirely to the applicable regulations in Saudi Arabian authorities.

Article 17 - General Provisions:

If any provision or article in this Terms of Use Agreement is canceled or becomes non-effective, the remaining provisions remain valid and enforceable.
This agreement, which may be amended from time to time, represents the understanding, agreement, and contract between Witforms and the user. The Arabic language is the official language for interpreting the terms of this agreement.
